Baird challenged his convictions in Massachusetts state court against Eisenstadt (plaintiff), a Massachusetts sheriff responsible for enforcing the statute. The trial court partially overturned Baird’s conviction. The court of appeals reversed and remanded. Eisenstadt appealed to the United States Supreme Court. The case comes to this Court on an appeal from the First Circuit the Court of Appeals.

Facts: Appellee attacks his conviction of violating Massachusetts law for giving a woman a contraceptive foam at the close of his lecture to students on contraception. In Commonwealth v.
